MSI has filed an amended complaint against Montgomery County's enforcement Bill 21-22E, a 'response' bill to NYSRPA v. Bruen. MSI then challenged Bill 21-22E with the filing of the Second Amended Complaint which can be found here. On May 28, 2021, Maryland Shall Issue, Engage Armament, ICE Firearms & Defensive Training, and several residents of Montgomery County, Maryland, filed suit against the County, challenging its enactment of Bill 4-21. That Bill criminalizes the mere possession of privately made firearms without providing compensation and redefines the meaning of "place of public assembly" to encompass virtually the entirety of Montgomery County just in order to criminalize otherwise perfectly lawful firearms possession in the home and elsewhere. The suit seeks declaratory and injunctive relief and an award of damages.

MSI had testified before the Council last winter that Bill 4-21 was a bad idea on many fronts. The Council nonetheless insisted on making criminals of law-abiding people. The County was undeterred by the many Maryland state laws and precedent from the Court of Appeals (Maryland's highest Court) that make clear that localities lack the power to enact new gun laws like Bill 4-21.

UPDATE AS OF 12/12/2023.  WE WON IN STATE COURT ON THE STATE LAW CLAIMS! On November 27, 2023, the Circuit Court for Montgomery County, MD, issued its Opinion granting MSI's motion for Summary Judgment as to all State Claims. That Opinion can be found here. The Court thus held that Chapter 57 of the Mont. Co. Code was unconstitutional under the Maryland Constitution because it was not a "local law," that Chapter 57 was otherwise preempted by a comprehensive and intertwined schemed of State law, including by express preemption imposed by State law and that Chapter 57 constituted a "Taking" of private property under the Takings Clause of the Maryland Constitution.  The court held that plaintiffs were entitled to declaratory and permanent injunctive relief on all three claims and is currently considering the parties' submissions concerning the wording of such orders.  The Court also agreed to certify the decision for immediate appeal. That will allow the County to appeal the decision to the Maryland Supreme Court, once the orders are issued.  Stay tuned.  We will post the orders once the Court issues them. This State Court judgment applies to Counts I-III of the Second Amended Complaint.

BUT THE FEDERAL COURT DENIED OUR MOTION FOR A PRELIMINARY INJUNCTION ON A SECOND AMENDMENT CLAIM AND THAT RULING IS ON APPEAL. Additional Counts, including a Count under the Second Amendment, are also pending in federal district court so the case is proceeding in federal court on the federal claims and in State court on the State law claims.  On July 6, 2023, the federal district court denied our motion for a preliminary injunction on the Second Amendment claim challenging the County's bans on the possession and transport of firearms (including by permit holders) and we took an immediate appeal from that denial to the Fourth Circuit. The case had been scheduled for oral argument for January 23, 2024, but the Fourth Circuit, for unexplained reasons, took it off the argument calendar. It will be rescheduled for later. Stay tuned.  Proceedings in both federal and State courts will continue. 

UPDATE 12/15/2023  The Circuit Court for Montgomery County has entered our proposed orders awarding final judgment in favor of plaintiffs, awarding injunctive relief in favor of plaintiffs and awarding a declaratory judgment in favor of plaintiffs. That means, among other things, that the County may not enforce its bans on possession and carry by persons who have been issued a MD wear and carry permit.
